These Terms & Conditions (“Terms”) govern the use of services provided by Monkey Mouth Web Hosting (“Company,” “we,” “us,” or “our”). By purchasing or using our services, you (“Client,” “you”) agree to these Terms.
1. Services Overview
Monkey Mouth Web Hosting provides:
- Managed WordPress web hosting
- Website maintenance and support plans
- Limited development and content support based on selected plan
Services are designed for small businesses and individual creatives and are intended to provide ongoing website stability, security, and minor updates—not unlimited development or redesign services.
2. Maintenance & Support Scope
Maintenance plans include hosting, updates, monitoring, backups, and a defined amount of monthly support time as outlined on our website and in the Maintenance Agreement / Scope of Support.
Work outside the scope of maintenance may require a separate quote or a temporary plan upgrade.
Unused monthly support time does not roll over.
3. Fair Use of Support Time
Maintenance plans are intended for reasonable, ongoing website care. Excessive or continuous requests that exceed the included support time or fall outside standard maintenance may require additional billing or plan changes.
This policy ensures fair access to support for all clients and helps maintain service quality.
4. Hosting, Uptime & Performance
We strive to provide reliable hosting and aim for high uptime; however, uninterrupted service is not guaranteed. Scheduled maintenance, updates, third-party outages, or events beyond our control may result in temporary interruptions.
Monkey Mouth Web Hosting is not responsible for downtime caused by:
- Third-party plugins, themes, or services
- Client-made changes without prior coordination
- Force majeure events
5. Backups & Data Responsibility
We provide regular off-site backups as part of our maintenance plans as a convenience service. Backup restoration is performed on a best-effort basis and is not guaranteed.
Clients remain responsible for maintaining their own independent backups of website content and data.
Monkey Mouth Web Hosting is not liable for data loss due to updates, hacks, accidental deletion, or third-party failures.
6. Client Responsibilities
Clients agree to:
- Provide timely access to required accounts, credentials, and content
- Avoid installing plugins, themes, or code without prior approval
- Maintain valid contact and billing information
Monkey Mouth Web Hosting is not responsible for issues caused by unauthorized changes or delays caused by the client.
7. Payments, Billing & Late Fees
Services are billed monthly unless otherwise agreed.
- Payments are due on the billing date
- Accounts more than three (3) days past due may have services suspended
- A $15 late fee may apply
- Chargebacks incur a $35 processing fee
Reinstatement or restoration services may incur additional fees.
8. Cancellations & Termination
Clients may cancel services at any time. Services remain active through the end of the current billing period.
Monkey Mouth Web Hosting reserves the right to suspend or terminate services for:
- Non-payment
- Violation of these Terms or the Acceptable Use Policy
- Abusive or threatening behavior
- Illegal or harmful activity
No refunds are provided for partial billing periods.
9. Refund Policy
A 7-day satisfaction guarantee applies to new hosting clients only. Refunds are not available after work has been performed or for:
- Domain registrations or renewals
- Third-party services
- Accounts suspended for policy violations
10. Acceptable Use
Clients may not use services for illegal activities, spam, malware distribution, or content that violates applicable laws.
Monkey Mouth Web Hosting reserves the right to immediately suspend or terminate services that negatively impact server performance, security, or other clients.
11. Intellectual Property
Clients retain ownership of their website content. Monkey Mouth Web Hosting retains ownership of proprietary tools, processes, and systems.
Unless otherwise agreed, Monkey Mouth Web Hosting may display non-confidential work in its portfolio.
12. Limitation of Liability
Monkey Mouth Web Hosting is not liable for indirect, incidental, or consequential damages, including loss of data or business interruption.
Total liability for any claim shall not exceed the amount paid by the client for services in the thirty (30) days preceding the claim.
13. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
14. Changes to Terms
We may update these Terms from time to time. Continued use of services constitutes acceptance of the revised Terms.
